⚠️ Please read these terms carefully. By creating an account or using WishThrift, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the platform.
1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your use of the WishThrift marketplace, operated at wishthrift.com (“Platform”, “we”, “us”, “our”). By registering an account, listing an item, making a purchase, or otherwise accessing the Platform, you (“User”, “you”) agree to these Terms in full.
These Terms form a legally binding agreement between you and WishThrift. If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Platform Description
WishThrift is a peer-to-peer online marketplace that enables private individuals (“Sellers”) to list, advertise, and sell used branded fashion items to other private individuals (“Buyers”). WishThrift acts solely as an intermediary technology platform and facilitates payment processing and dispute resolution services.
WishThrift does not own, inspect, warehouse, or ship any items listed on the Platform. All transactions are between Buyers and Sellers directly. WishThrift is not a party to any sale contract between a Buyer and Seller.
3. Accounts & Eligibility
3.1 Eligibility
You must be at least 18 years old to create an account. By registering, you confirm that all information you provide is accurate and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@wishthrift.com if you suspect unauthorised access.
3.3 One Account Per Person
Each individual may maintain one active account. Creating multiple accounts to circumvent bans, limits, or founding seller status is prohibited and may result in permanent suspension of all associated accounts.
4. Seller Rules & Obligations
4.1 Listing Accuracy
Sellers must provide accurate descriptions, clear photographs, and correct condition grading for all items. Listings must describe the item as it actually is, including any flaws, damage, or wear.
4.2 Authenticity
All items listed must be genuine branded items. Listing counterfeit, fake, replica, or “inspired by” goods is strictly prohibited and constitutes a serious breach of these Terms. WishThrift reserves the right to remove any listing suspected of being counterfeit without prior notice.
4.3 Shipping Obligation
Upon receiving notification of a confirmed sale, Sellers must ship the item within 3 calendar days or arrange a confirmed local pickup with the Buyer. If a Seller fails to ship or arrange pickup within 3 days without communication, the order may be auto-cancelled and the Buyer refunded in full.
4.4 Tracking
For shipped orders, Sellers must enter valid tracking information into the seller dashboard within 24 hours of dispatch. Failure to provide tracking may delay payment release.
4.5 Condition Grading
Items must be graded honestly: New with Tags / Like New / Excellent / Good / Fair. Misrepresenting condition is grounds for dispute resolution in the Buyer’s favour.
5. Buyer Rules & Obligations
5.1 Confirm Receipt
Buyers are expected to inspect their purchase upon delivery and tap “Confirm Receipt” in their account if satisfied. If a Buyer does not confirm or raise a dispute within 7 days of the estimated delivery date, funds will be automatically released to the Seller.
5.2 Good Faith
Buyers must act in good faith. Initiating unfounded disputes, claiming non-delivery or misrepresentation falsely, or attempting to retain items without payment constitutes fraud and may result in account suspension and legal action.
5.3 Local Pickup
When arranging local pickup, Buyers must confirm receipt through the Platform at the time of collection. Payment is released only upon Platform confirmation.
6. Fees & Payments
6.1 Standard Platform Fee
WishThrift charges a platform fee of 5% of the final sale price on every completed transaction for standard sellers. This fee is automatically deducted before the remaining amount is transferred to the Seller.
6.2 Founding Seller Fee — 0%
The first 100 registered sellers (“Founding Sellers”) are granted a permanent 0% platform fee on all their sales. This benefit is:
- Non-transferable and tied to the original account holder
- Permanent as long as the account remains in good standing
- Subject to termination if the account is found to be created fraudulently or in violation of these Terms
6.3 Payment Processing
All payments are processed by Stripe. Stripe’s standard processing fee (currently 2.9% + $0.30 per transaction) is borne by the Seller. WishThrift does not retain Stripe’s fee. Stripe’s fees are subject to change; refer to stripe.com for current rates.
6.4 No Listing Fees
Listing is always free and unlimited for all sellers.
6.5 Payout Timeline
Funds are transferred to the Seller’s Stripe account within 1–3 business days after the escrow release event (see Section 7).
7. Escrow & Payment Release
7.1 How Escrow Works
When a Buyer completes checkout, payment is held in secure escrow via Stripe until one of the following occurs:
- Buyer Confirmation: The Buyer taps “Confirm Receipt”, indicating they have received and accepted the item.
- Automatic Release: 7 calendar days pass after the estimated delivery date without the Buyer confirming receipt or raising a dispute.
7.2 Dispute Hold
If a Buyer raises a dispute before confirmation, funds remain in escrow until the dispute is resolved (see Section 9).
7.3 Refunds
If a Seller fails to ship within 3 days, or if a dispute is resolved in the Buyer’s favour, the full payment is refunded to the Buyer’s original payment method. Stripe’s processing fee may be non-refundable per Stripe’s current policy.
8. Prohibited Items & Conduct
8.1 Prohibited Items
- Counterfeit, fake, or replica branded goods
- Stolen goods or items obtained by fraudulent means
- Hazardous materials, weapons, or illegal items
- Adult content or items requiring age verification
- Non-fashion items (electronics, food, services, digital goods)
- Items that infringe third-party intellectual property rights
8.2 Prohibited Conduct
- Conducting transactions off-platform to avoid WishThrift fees
- Harassing, threatening, or abusing other users
- Creating fake reviews or manipulating the rating system
- Using automated bots or scrapers on the Platform
- Impersonating other users or WishThrift staff
- Spamming other users with unsolicited messages
9. Disputes & Resolution
9.1 Opening a Dispute
A Buyer may open a dispute before confirming receipt if the item: (a) was not received, (b) significantly differs from its description, or (c) is not authentic as listed. Disputes must be opened within 7 days of the estimated delivery date.
9.2 Dispute Process
WishThrift will review evidence from both parties (photos, tracking, messages) and make a binding decision within 5 business days. Both parties agree to cooperate fully.
9.3 Outcomes
WishThrift may: (a) release funds to the Seller, (b) refund the Buyer in full, or (c) arrange a partial refund. WishThrift’s decision is final and binding.
9.4 Chargebacks
Users agree to resolve disputes through WishThrift’s process before initiating a chargeback. Fraudulent chargebacks may result in account suspension.
10. Liability Cap & Disclaimers
10.1 No Warranty
The Platform is provided “as is” without warranties of any kind. WishThrift does not warrant that the Platform will be uninterrupted or error-free.
10.2 Liability Cap
To the maximum extent permitted by law, WishThrift’s total liability to any User shall not exceed the greater of: (a) total fees paid by that User to WishThrift in the prior 12 months, or (b) $100 USD.
10.3 Exclusions
WishThrift is not liable for: loss of profits, data, or goodwill; indirect or consequential losses; losses from transactions between Users; or the actions of any User.
11. Platform-Not-Seller Clause
ℹ️ Important: WishThrift is a technology platform, not a retailer or seller. WishThrift does not own, manufacture, inspect, or sell any items listed on the Platform.
All items are listed by independent third-party Sellers. WishThrift is not responsible for the quality, safety, authenticity, legality, or fitness for purpose of any item listed or sold through the Platform. Any contract of sale is formed directly between Buyer and Seller.
WishThrift acts as a limited payment intermediary and dispute facilitator only. WishThrift does not endorse any listing, Seller, or item on the Platform.
12. Intellectual Property
The WishThrift name, logo, design, and Platform software are the intellectual property of WishThrift and may not be used, copied, or reproduced without written permission.
By uploading content to the Platform, you grant WishThrift a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content for operating and promoting the Platform.
You represent that you own or have the right to use all content you upload, and that it does not infringe any third-party intellectual property rights.
13. Termination
WishThrift may suspend or terminate any account at any time for violation of these Terms, fraudulent activity, or conduct harmful to the Platform or its users. We will provide notice where reasonably practicable.
You may close your account at any time by contacting hello@wishthrift.com. Outstanding transactions must be completed before account closure.
Upon termination, your right to use the Platform ceases immediately. Sections 10, 11, 12, and 14 survive termination.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory local consumer law in your country provides otherwise.
For Users based in the United States, these Terms are additionally subject to applicable US federal and state consumer protection laws.
15. Changes to These Terms
WishThrift may update these Terms at any time. When we make material changes, we will notify you by email or prominent notice on the Platform at least 14 days before the changes take effect. Continued use after changes take effect constitutes acceptance of the updated Terms.
