These Terms of Service (“Terms”) govern your use of wishthrift.com (the “Service”), operated by WishThrift (“we”, “us”, “our”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service. These Terms work alongside our Privacy Policy, which forms part of this agreement.

1. About WishThrift

WishThrift is a free classifieds platform connecting buyers and sellers of second-hand items worldwide. We are not a party to any transaction. We do not handle payments, take possession of goods, arrange shipping, or guarantee the existence, quality, safety, legality, or accuracy of any listing. All transactions are arranged and completed directly between buyers and sellers.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract in your country to register an account or post listings. By registering you confirm that you meet these requirements and that the information you provide is true and current. One account per person.

3. Your Account

• You are responsible for keeping your password confidential and for all activity that occurs under your account.
• You must notify us immediately at legal@wishthrift.com if you suspect unauthorised access.
• You may close your account at any time from your account settings or by emailing us. Closing your account removes your data as set out in the Privacy Policy.

4. Seller Responsibilities

• Describe items accurately — title, photos, condition, price, currency, and location must all be truthful and current.
• Only list items you own and have the legal right to sell.
• Respond to genuine buyer enquiries in a reasonable time.
• Mark items as sold promptly once a sale is completed, and remove listings for items that are no longer available.
• Comply with all tax, consumer-protection, and trading laws that apply to you in your jurisdiction. If you sell as a business, you are responsible for identifying yourself as a trader where required by law (e.g., UK Consumer Contracts Regulations).
• Honour the price and condition you advertised once a sale is agreed in writing through the on-site messaging system.

5. Buyer Responsibilities

• Inspect the item, photos, and seller profile carefully before committing to buy.
• Arrange payment and collection or delivery directly with the seller.
• Never wire money, send gift cards, or pay in cryptocurrency to a seller you have not met or independently verified. Treat any such request as a red flag and report it to us.
• Communicate respectfully and only about the listing in question.

6. Prohibited Items and Content

The following are strictly prohibited on WishThrift, regardless of jurisdiction:

• Weapons, firearms, ammunition, replicas, or weapon parts.
• Illegal drugs, drug paraphernalia, and any controlled substance.
• Prescription medication, vapes, e-liquids, alcohol, or tobacco products.
• Counterfeit, replica, or pirated goods, and items that infringe a third party’s trademark, copyright, or other IP rights.
• Adult content, services of a sexual nature, or escort services.
• Live animals, animal remains, ivory, or any item derived from a CITES-listed species.
• Stolen goods or items of unknown provenance.
• Hazardous materials, recalled products, used cosmetics or used intimate items.
• Financial instruments, securities, lottery tickets, or any item promising a financial return.
• Services in lieu of physical goods (with the exception of services directly attached to delivering a listed item).
• Anything that is illegal in either the seller’s or buyer’s jurisdiction.
• Hate-speech material, content that incites violence, or content that targets a person or group on protected characteristics.

7. Platform Rules

• One account per person. Do not create duplicate, fake, or impersonation accounts.
• Do not send unsolicited or bulk messages to other users. Use the messaging system only to discuss specific listings.
• Do not post misleading, fraudulent, or deceptive listings. Do not manipulate search results or category placement.
• Do not scrape, harvest, copy, or systematically download data from the Service, or attempt to access any non-public area.
• Do not interfere with the Service’s security, integrity, or performance, and do not bypass any safety, verification, or anti-abuse feature.
• Do not circumvent or attempt to circumvent fees, reporting tools, or the messaging system (e.g., by directing buyers to off-platform sites to defraud them).
• Treat all users with respect. Harassment, threats, hate speech, or any form of abuse will result in immediate account termination.

8. Your Content — Listings, Photos, Messages, Reviews

You retain ownership of the content you post (listings, photos, messages, reviews). By posting content on WishThrift you grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, copy, display, distribute, and create thumbnails or derivatives of that content, solely for the purpose of operating, promoting, and improving the Service. This licence ends when you remove the content or close your account, except for back-up copies that may persist for a reasonable period.

You represent and warrant that you own or have the necessary rights to the content you post, that it does not violate these Terms, and that it does not infringe anyone else’s rights. We may remove any content at our discretion if we believe it violates these Terms or the law.

9. Reviews and Ratings

• Reviews must reflect your genuine first-hand experience with a seller.
• Do not post fake reviews, do not pay or accept payment to influence reviews, and do not coordinate review campaigns.
• We may remove reviews that are off-topic, abusive, defamatory, or appear to be manipulated.

10. Verified Seller Programme

The Verified Seller Programme is optional. Sellers may apply by submitting an ID document for review — full details, including what we collect, how it is stored, and how long it is retained, are set out in the Privacy Policy §7. A verified badge on a profile means we have reviewed the seller’s submitted ID against the name they declared. It does not amount to a guarantee, endorsement, or warranty of any kind, and it does not transfer responsibility for any transaction to WishThrift. Buyers should still exercise normal caution.

We may approve, reject, revoke, or pause verification at our discretion, including where we suspect the submitted document is forged, mismatched, or otherwise insufficient.

11. WishThrift’s Role and Disclaimer

WishThrift is a venue only. We do not inspect items, take delivery of items, hold funds, escrow payments, vet most users, or guarantee that any seller will perform as promised. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability, to the maximum extent permitted by law.

12. Disputes Between Users

Any dispute about an item, payment, condition, delivery, or refund is solely between the buyer and the seller. WishThrift is not a party and will not adjudicate. We can help by removing fraudulent listings or accounts where appropriate — please report issues to legal@wishthrift.com with the listing URL and your evidence. If a dispute relates to consumer rights (for example, a trader selling to a consumer in the UK or EU), those statutory rights apply directly between buyer and seller and are not affected by these Terms.

13. Limitation of Liability

To the maximum extent permitted by law, WishThrift, its founders, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, data, or goodwill, arising out of or in connection with your use of the Service, any transaction with another user, or any content posted on the Service. Where liability cannot lawfully be excluded (for example, for death or personal injury caused by negligence, or for fraud), nothing in these Terms limits or excludes that liability.

Our total cumulative liability to you for any claim arising out of these Terms or the Service is limited to the greater of (a) the total fees you have paid to us in the 12 months preceding the claim, or (b) GBP 50.

14. Indemnity

You agree to indemnify and hold harmless WishThrift and its team from any claims, damages, costs, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your content, your transactions with other users, or your violation of any law or third-party right.

15. Account Termination

We may suspend or terminate your account, with or without notice, if we believe you have breached these Terms, engaged in fraudulent or illegal activity, or pose a risk to other users or the Service. You may close your account at any time from your account settings or by emailing us. Sections that by their nature should survive termination — including §8 (your content licence in respect of content still hosted), §13 (liability), §14 (indemnity), and §18 (governing law) — will continue to apply.

16. Cookies, Tracking, and Data

Your privacy choices, including cookie consent and analytics, are governed by our Privacy Policy. By using the Service you acknowledge the data-handling practices described there.

17. Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, for material changes, notify users by email or with a prominent on-site notice at least 14 days before the change takes effect. Continued use of the Service after a change means you accept the revised Terms. If you do not agree, you should close your account before the change takes effect.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Service. If you are a consumer in another country, this does not deprive you of the protection of any mandatory consumer laws of your country of residence.

19. Communications

By creating an account you agree that we may send you transactional emails relating to your account, listings, and messages, and that we may post operational notices on the Service. These are not marketing communications and you cannot opt out of them while your account is active.
